§ 44-68. Certain changes not prohibited.

(a)

Nothing in this Ordinance shall be construed to prevent the ordinary maintenance or repair of any exterior architectural feature in a historic district or on a landmark which does not:

(1)

Involve a change in design, materials or outer appearance thereof; or

(2)

Involve the construction, reconstruction, alteration, restoration or demolition of any such feature which the Building Inspector shall certify is required by the public safety because of an unsafe or dangerous condition.

(b)

Nothing herein shall be construed to prevent the maintenance of or, in the event of an emergency, the immediate restoration of any existing above-ground utility structure without approval by the Commission.
