§ 18-6. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abandoned motor vehicle is one that is left:

    (1)

    On county property in violation of section 18-111 et seq.; or

    (2)

    For longer than 24 hours on county property.

    Animal includes any live, vertebrate creature, specifically including but not limited to dogs, cats, farm animals, birds, fish and reptiles.

    Charitable organization means an organization that has a humane, philanthropic or benevolent purpose, including environmental, health, educational, humane, patriotic, scientific, artistic, social welfare and civic, whose activities benefit humanity or a significant rather than limited segment of the community without expectation of pecuniary profit or reward and is exempt from taxation under either G.S. 105-130.11(a)(3), G.S. 105-130.11(a)(5) or section 501(c)(3) of the Internal Revenue Code as amended.

    County facilities and county property mean any and all real property owned, leased as lessee, operated, occupied, managed or controlled by the county for any purpose; except for purposes of section 18-186 et seq., it shall not include any facility or property used or operated by the county department of animal control, including but not limited to the county animal shelter or any other facility operated for the restraint, care, adoption and disposition of animals.

    Firearm means a handgun, shotgun or rifle that expels a projectile by action of an explosion and firearm ammunition.

    Firearm ammunition means the projectiles with their fuses, propelling charges and primers fired from a firearm.

    Handgun means a pistol, revolver or other gun that has a short stock and is designed to be fired by the use of a single hand.

    Knife means a cutting instrument consisting of a sharp blade. A pocket knife with a blade not exceeding four inches long that provides for its point and cutting edge to be entirely enclosed by its handle and that may not be opened by throwing, explosive or spring action is not a knife, the carrying or possession of which is prohibited under this chapter.

    Motor vehicles includes but is not limited to automobiles, motorcycles, mopeds, trucks, or any machine designed or intended to travel over land or water by self-propulsion or while attached to a self-propelled vehicle.

    Skateboarding and related activities includes but is not limited to the use of any skateboard, scooter, roller blades, roller skates, minibike, go-cart, or any other wheeled instrument used primarily or traditionally for recreational or sport purposes.

    Solicitation and solicit mean but are not limited to the following:

    (1)

    Requests for contributions from persons for charitable or eleemosynary purposes;

    (2)

    Business activities of itinerant merchants, sales representatives, promoters, drummers, peddlers and hawkers; and

    (3)

    Canvassing persons for contributions for the private benefit of the canvasser or any other person.

    It shall not include any activities associated with any government-sponsored or county-sponsored events.

    Tow, in any of its forms, includes to remove a vehicle by any means, including towing, and to store the vehicle.

    Tower means the person who towed a vehicle.

    Towing fee means the fee charged for towing and storing.

    Weapon of mass death and destruction means:

    (1)

    Any explosive, incendiary, poison gas or radioactive material:

    a.

    Bomb;

    b.

    Grenade;

    c.

    Rocket having a propellant charge of more than four ounces;

    d.

    Missile having an explosive or incendiary charge of more than one-quarter ounce;

    e.

    Mine; or

    f.

    Device similar to any of the devices described in this subsection;

    (2)

    Any type of weapon (other than a shotgun or a shotgun shell of a type particularly suitable for sporting purposes) which will, or which may be readily converted to, expel a projectile by the action of an explosive or other propellant, and which has any barrel with a bore of more than one-half inch in diameter;

    (3)

    Any firearm capable of fully automatic fire, any shotgun with a barrel less than 18 inches in length or an overall length of less than 26 inches, any rifle with a barrel less than 16 inches in length or an overall length of less than 26 inches, any muffler or silencer for any firearm, whether or not such firearm is included within this definition. For the purposes of this definition, the term "rifle" is defined as a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder;

    (4)

    Any combination of parts either designed or intended for use in converting any device into any weapon described in this section and from which a weapon of mass death and destruction may readily be assembled; or

    (5)

    Radioactive material, which means any solid, liquid or gas that emits or may emit ionizing radiation spontaneously or becomes capable of producing radiation or nuclear particles when controls or triggering mechanisms of any associated device are operable.

    A small container of tear gas, pepper spray or mace used or intended to be used for personal defense is not a weapon of mass death and destruction.
